Q: What is common-law marriage?

A: A common-law marriage is a process by which a couple can agree to be married and tell others they are married without getting a license or having a ceremony.


Q: What would prevent a common-law marriage from being considered common-law?

A: One has to be eligible, so you can’t be married to someone else at the time. You also need to meet the age requirement, which according to a recent court ruling could be as young as 12 for girls and 14 for boys. Those are the only legal restrictions, and there is no time limit to establish a common-law marriage.


Q: What is the process for a divorce in a common-law marriage?

A: All marriages are the same when it comes to divorce. One has to go through the filing of a petition through a district court and as you would if you had had a ceremonial marriage.


Q: If one person believes they are married and the other doesn’t, does that invalidate the common-law marriage?

A: It is very common there is a contested issue over the existence of a common-law marriage at the time of divorce. Often at that time one is certain the couple is married and the other is not. Q: Is common-law marriage in Colorado recognized in other states?

A: Yes, generally the Constitution provides that a legal status achieved in one state will then be recognized in the other states. So if you were in a state that recognizes common-law and go to another state that does not have common-law, if it occurred in a common-law state, the subsequent state of residence will recognize it.
